100Hires Customer Terms of Service

These Customer Terms of Service (“Terms”) form a legally binding agreement between 100Hires Inc. (“100Hires”, “we” or “us”) and the person or entity that creates an account or otherwise uses our recruitment software and related websites (“Customer”, “you” or “your”). If you use our Service on behalf of a company, you confirm that you have authority to bind that company to these Terms.
Plain‑language promise: We’re currently a lean startup team, and we’ve written these Terms in clear language so that organizations of any size — from solo recruiters to enterprise teams — can understand them. These Terms are short and straightforward so that small and medium customers can understand them without a team of lawyers.
1. Definitions
- “Service” – the web application, APIs and any related support that 100Hires makes available at .
- “User” – an individual whom you invite or permit to access the Service under your account.
- “Customer Data” – any data, files or content that you or your Users submit to the Service.
- “Subscription Term” – the period of time you have paid for access to the Service, shown on your checkout or invoice.
2. Access to the Service
- Licence. While these Terms are in effect and you pay all fees, we grant you a non‑exclusive, non‑transferable right for your Users to access and use the Service for your internal business purposes.
- Account Security. You are responsible for all activity that occurs under your account. Keep log‑in credentials confidential and let us know right away if you believe your account has been compromised.
- Eligibility. The Service is intended for adults (18 +). You may not use the Service if local laws bar you from doing so.
3. Fees and Payment
- Prices. Subscription fees are shown in the online checkout or on an invoice that we send to you. Taxes will be added if applicable.
- Billing Period. All fees are charged in advance for the entire Subscription Term unless we agree otherwise in writing.
- No Refunds. All payments are final and non‑refundable. We do not issue credits or refunds for partial months, unused features or early cancellation. Make use of our free trial to ensure the Service meets your needs before subscribing.
- Late Payments. If a charge is rejected or an invoice is overdue by 10 days or more, we may suspend access to the Service until the balance is paid in full.
4. Acceptable Use
You and your Users must not: - break any laws or regulations in connection with the Service; - upload malware or use the Service to send spam; - attempt to reverse engineer or interfere with the Service; - store or process Sensitive Personal Data (e.g. medical, financial, children’s data) in the Service. We may suspend or terminate accounts that violate this section.
5. Customer Data
- Ownership. You own all Customer Data. These Terms do not grant us any rights to Customer Data except the limited licence below.
- Licence to 100Hires. You grant us a worldwide, non‑exclusive licence to host, copy and process Customer Data only as needed to operate and improve the Service.
- Back‑ups. We back up databases regularly, but we recommend you keep your own copies of critical data.
6. Security and Privacy
We use industry‑standard security measures such as encrypted HTTPS, firewalls and least‑privilege access. Full details of data handling are described in our Privacy Policy. We do not currently hold ISO 27001, SOC 2 or similar third‑party certifications.
7. Term and Termination
- Auto‑Renew. Your subscription renews automatically for successive periods equal to the initial Subscription Term, unless either party gives written notice of non‑renewal at least 15 days before the current term ends.
- Early Cancellation. You may cancel at any time; however, per section 3.3, no refunds will be provided, and access will continue until the end of the paid term.
- Termination for Cause. Either party may terminate these Terms immediately if the other party materially breaches them and does not cure within 30 days of written notice.
- Effect. Upon termination or expiry, your account will be deactivated. We will delete Customer Data after 90 days unless legal obligations require longer retention.
8. Disclaimers and Limitation of Liability
- As‑Is Service. The Service is provided “as is” without warranties of any kind, express or implied.
- Limitation. To the maximum extent permitted by law, each party’s aggregate liability arising out of or related to these Terms will not exceed the fees paid by you to 100Hires in the 12 months preceding the claim.
- Exclusion of Indirect Damages. Neither party will be liable for lost profits, lost data or any indirect, special or consequential damages.
9. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will email you or post a notice in the app at least 30 days before the update takes effect. Continued use of the Service after the effective date constitutes acceptance.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and each party consents to personal jurisdiction there.
